1. Introduction
These Terms and Conditions (“Terms”) govern your use of the Klicktake mobile applications and related services (“Klicktake”, “we”, “us”, or “our”) in the Syrian Arab Republic.
By creating an account, accessing, or using Klicktake (Customer App, Merchant App, or Courier App), you agree to be bound by these Terms.
If you do not agree to these Terms, you must stop using Klicktake immediately.
2. Definitions
Customer: A user who places orders through the Klicktake customer application.
Merchant: A store, restaurant, or business that lists products or services on Klicktake.
Courier / Driver: An independent delivery person who accepts and completes deliveries through the Klicktake courier application.
Order: A request placed by a Customer to purchase products or services from a Merchant and have them delivered by a Courier.
Platform: The Klicktake applications and any related websites, APIs, or back-office systems.
3. Scope of Service
Klicktake is a technology platform that:
Connects Customers with Merchants to place orders; and
Connects Customers and Merchants with Couriers to deliver such orders.
Klicktake does not produce, manufacture, or own the products listed by Merchants, and does not employ Couriers. Merchants and Couriers operate as independent third parties.
4. Eligibility and Account
4.1 You must be at least 18 years old and legally capable of entering into contracts under Syrian law.
4.2 You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
4.3 You agree to provide accurate, current, and complete information, including your name, address, phone number, and payment details.
5. User Roles and Responsibilities
5.1 Customers
Provide accurate delivery address and contact details.
Be available to receive the order at the agreed time.
Check the order upon delivery and report issues promptly through support channels.
5.2 Merchants
Are solely responsible for: product quality, legality, descriptions, prices, packaging, and compliance with all applicable laws and health regulations in Syria.
Must ensure that products offered through Klicktake are lawful and safe.
Must handle complaints related to product defects or quality.
5.3 Couriers / Drivers
Operate as independent contractors, not employees of Klicktake.
Must hold valid identification and any required driving permits and vehicle documents.
Must comply with traffic laws, safety regulations, and local laws at all times.
Are responsible for the safe handling and delivery of orders.
6. Orders, Prices, and Payments
6.1 Prices, fees, delivery charges, and estimated times are shown in the app before you confirm the order.
6.2 By confirming an order, you authorize Klicktake to collect the total amount on behalf of the Merchant and Courier, using the available payment methods (e.g., cash on delivery or any electronic methods supported in Syria).
6.3 In case of obvious pricing errors or unavailable items, Klicktake and the Merchant reserve the right to cancel or modify the order with notice to the Customer.
7. Cancellations, Refunds, and Modifications
7.1 Cancellation rules may differ depending on the status of the order (e.g., accepted, prepared, on the way). Some orders may become non-cancellable once preparation or delivery has started.
7.2 Any refunds (full or partial) will be handled according to Klicktake’s internal policies and the applicable Syrian laws, and may be issued as balance, vouchers, or other methods shown in the app.
7.3 If the Courier is unable to deliver due to incorrect address or Customer unavailability, delivery fees may still be charged.
8. Delivery
8.1 Delivery times are estimates and may change due to traffic, weather, security, or other factors beyond our control.
8.2 The risk of loss passes to the Customer upon delivery of the order to the Customer or to any person at the delivery address who appears authorized to receive it.
8.3 Couriers may contact the Customer by phone or in-app to complete delivery.
9. Illegal and Dangerous Items
Klicktake strictly prohibits the use of the Platform for any illegal or dangerous items. It is forbidden to list, order, transport, or deliver any of the following (non-exhaustive list):
Narcotic drugs, psychotropic substances, or any controlled substances prohibited under Syrian law.
Weapons of any kind (firearms, ammunition, knives intended as weapons, military equipment, etc.).
Explosives, fireworks, flammable or highly combustible materials.
Toxic, radioactive, or chemical substances that may harm health, safety, or the environment.
Counterfeit goods, stolen items, or any items obtained through illegal means.
Any products or materials that are prohibited by applicable laws, regulations, or government authorities in the Syrian Arab Republic.
Merchants are responsible for ensuring that all listed products are legal and safe.
Couriers must refuse and report any order that they reasonably suspect involves illegal or dangerous items.
Klicktake may suspend or terminate any account involved in such activities and report it to competent authorities.
10. Acceptable Use
You agree not to:
Use Klicktake for fraudulent, abusive, or unlawful purposes.
Interfere with or disrupt the Platform or its servers.
Attempt to hack, reverse engineer, or access the systems without authorization.
Create multiple accounts to abuse promotions, discounts, or referral programs.
Klicktake may suspend or terminate accounts that violate these rules.
11. Ratings, Reviews, and Content
11.1 Customers may rate and review Merchants and Couriers. You must be honest and respectful and avoid offensive or defamatory language.
11.2 Klicktake may remove any content that violates these Terms or local laws.
11.3 By submitting content (reviews, feedback, etc.), you grant Klicktake a non-exclusive, worldwide, royalty-free license to use, display, and reproduce such content in connection with the Platform.
12. Privacy and Communications
12.1 Klicktake collects and processes personal data in order to operate the Platform, prevent fraud, and improve services.
12.2 By using the app, you consent to receive notifications, SMS, and calls related to your orders, security alerts, and service updates.
12.3 For marketing messages, you may be able to opt-out through app settings where available.
13. Intellectual Property
All logos, trademarks, designs, and software used in Klicktake are owned by us or licensed to us. You may not copy, modify, or distribute any part of the Platform without our prior written consent.
14. Suspension and Termination
We may suspend or terminate your account, fully or partially, if:
You violate these Terms or applicable laws;
You abuse the Platform, promotions, or other users; or
We are required to do so by law or competent authorities.
You may also delete your account through the app or by contacting support, subject to settlement of any outstanding amounts.
15. Limitation of Liability
To the maximum extent permitted by Syrian law:
Klicktake is not responsible for the acts or omissions of Merchants or Couriers;
We are not liable for product quality, quantity, or suitability;
We are not liable for delays, failures, or damages caused by events beyond our reasonable control (force majeure).
Nothing in these Terms limits liability for death or personal injury caused by gross negligence or willful misconduct where such limitation is not permitted by law.
16. Indemnity
You agree to indemnify and hold Klicktake, its owners, and staff harmless from any claims, losses, or damages arising from:
Your breach of these Terms;
Your misuse of the Platform; or
Your violation of any law or third-party rights.
17. Changes to the Service and Terms
We may update the Platform, features, or these Terms from time to time.
When we make material changes, we will notify you through the app or by other reasonable means. Your continued use after such changes constitutes your acceptance of the updated Terms.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws and regulations of the Syrian Arab Republic.
Any dispute arising out of or relating to these Terms or your use of Klicktake shall be subject to the jurisdiction of the competent courts in Syria, unless mandatory laws require otherwise.
